Government of Ontario Repeals Bill 124

On February 23, 2024, the Government of Ontario announced that it had repealed the Protecting a Sustainable Public Sector for Future Generations Act, 2019 (“Bill 124”) in its entirety through an Order in Council. 

This follows the Ontario Court of Appeal’s recent decision on February 12, 2024 finding Bill 124 to be unconstitutional with respect to represented (unionized) employees only. Our previous article covering the Court of Appeal’s decision is available here.

The Government had previously announced that it would not be appealing the Court of Appeal’s decision and would instead urgently introduce regulations to exempt non-unionized and non-associated workers from Bill 124 until its repeal. No such regulations had been introduced prior to today’s announcement.
